If you wish to disable the footer, you can include either an "Unsubscribe" merge tag ($[LI:UNSUBSCRIBE]$ ) or "Org Opt Out" merge tag ($[LI:ORG_OPTOUT]$). Then you can click the Change Theme option and remove the footer.
